Purpose

Blenddy respects the privacy of the visitors to any and all parts of our website and apps (iOS and Android), which we will refer to from now on as the (“Site”). When you use the Site, you’re entrusting us with your information. Our Privacy Policy will help you understand what information we collect, why we collect it, and how you can update, manage, or delete your information.

Who

We are daCompany Tech, Inc., makers of Blenddy, a digital app dedicated to helping people make better choices with products they consume. The Site is intended for informational purposes only. None of the information gathered or shown in the Site, website, or newsletter constitutes medical advice.

Information We Collect

The Site collects information to our servers to provide better services to all its users. For example - from figuring out what can help your symptoms, what’s popular in your area, to more personal things like the type of strain that might be good for you, and displaying relevant partner products while using the Site. The information the Site collects, and how that information is used, depends on how you choose to use our services. This information may be processed by us in the United States where laws regarding processing of personal information may be less stringent than the laws in your country. Following is information you create or provide to us.

Account Information / Username

You’ll create an account to work with the Site by providing an email or Facebook account. This email or Facebook account will subsequently be used to log into your account. A username, of your choosing, will be used within the Site to identify you to other users. To be clear, the only time we don’t use your custom username is during account log-on. You can also choose to use our services incognito, but certain features of the app will be unavailable if you do so.

Password

To keep your account safe, choose a strong password that is at least 8 characters. Your password should contain a mix of letters, numbers, and symbols. For best practice, don't use a password you've used for other accounts or websites. Likewise, don't use this password anywhere else.

Email Address

We require a verified email address to create an account on the Site. We use this information for account access, keep your account secure, help you get back in if you’ve forgotten your password, and get notifications from the Site’s services.

Gender 

We use your gender to make the Site’s services more personal. Your gender isn’t shared with other people who use the Site. When you specify your gender, you enable us to:

·  Personalize messages and other text that refer to you. If you don't specify your gender, we'll refer to you in gender-neutral terms, like "Send them an update."

​

·  Provide relevant and tailored recommendations you might be interested in, like product suggestions or ads.

Age

By using the Site, you are acknowledging that you have read and consent to our Privacy Policy. We are a general audience site, and do not direct any of our content specifically at children under 18 years of age. Your age isn’t visible to others unless you share your birthday with specific people. Although we have age restrictions and verifications in place, if we learn or have reason to suspect that a Site user is under age 21, we will promptly delete any personal information in that user’s account. Different states have different age limits on product access, so please review your local laws to ensure you are in compliance.

Strain and Product Data

Within the Site, we collect information on but not limited to your strains' profile, consumable product, your preferences, tools, quantities consumed, product pairings, effects, and reviews. This content is used to provide services and to make your experience as seamless as possible, improve your shopping experience, display product, content, advertising, product recommendations, and services that you are likely interested in.

Images

You may choose to include pictures with your strains within the Site. In order to provide our services, we need certain permissions from you. You own the content that you create and share on the Site. You are free to share your content with anyone else. When you share an image that is covered by intellectual property rights, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host your content. We will not use, distribute, modify, or create derivative works of your content. You can end this license any time by deleting your content or account. You should know that content you delete may persist for a limited period of time in backup copies due to technical reasons. Content you delete may continue to appear if you have shared it with others and they have not deleted it.

Location

We collect precise Location Data as part of the functionality of our Services, to ensure working within Apple’s guidelines to operate only in places with proper legislation, offer geographically relevant services, offers, ads, and to conduct analytics to improve the Services. We may collect precise Location Data in several ways, such as through your wireless carrier, based on Wi-Fi access point location, or directly from the device on which you use the Services.

 

In all events, Location Data is not collected unless you have "allowed" its collection. If you decline to allow Location Data collection in the app, this may hinder functionality of the app per Apple’s guidelines.

Phone Number

We also collect your mobile number and contacts if you choose to engage with them using our Friends feature within the Site. Your number is used to verify that you know someone enough that their phone number is contained in your contacts. Your direct added contacts will have additional permissions to communicate with you through the Site. Your phone number can also be used on other Site services. For example, if you forget your password, your recovery phone number helps you get back into your account, and to send you notifications on products.

Friends 

If you choose, you can use our “Friends” feature to locate other people who use the Site either through your contacts list, third party social media sites or through a search of usernames within the Site. If you choose to find your friends through your device's contacts list, the Site will access your contacts list to determine whether or not someone associated with your contacts is using the Site. If you choose to find your friends through a third-party social media site, you will be prompted to the third-party service and you understand that any information that such service may provide to us will be governed by this Privacy Policy. If you choose to find your friends through a search of names or usernames on the Site, then simply type a name to search and we will perform a search on our Service. If you choose to invite someone to the Site through our Friends feature, you may select a person directly from the contacts list on your device and send a text or email from your personal account. You understand and agree that you are responsible for any charges that apply to communications sent from your device, and because this invitation is coming directly from your personal account, the Site does not have access to or control this communication.

Sharing

If you choose, you can use our Share Feature to share your written reviews of product. You can control what data you share at each level. This data is shared through your username with other users. Users can see your badge profiles, which may include but not limited to your type designation, experience level. None of your personal profile data will be shared.

​

Twitter, Instagram and Facebook

Posting images and reviews to external social media services (Twitter Feed, Instagram Stories, and Facebook News Feed) can be done directly from Blenddy if you choose. To create personalized recommendations that are unique and relevant to you, we may collect data based on your interests and activities from these platforms, and how you use and interact with our Products, and the people, places or things you're connected to and interested in. Each of these services have their own Terms and Conditions, which need to be adhered to and can be found here: Twitter, Instagram, Facebook

Product Reviews

Periodically, you may choose to submit a product review or participate in a survey. During this process, we may ask for personal information such as an email address. In a review, it is not required to provide personally identifiable information. Any personally identifiable information that you submit as part of the review can be read or used by other visitors to the Site. We are not responsible for personally identifiable information that you choose to submit as part of your review.

Submissions 

All information submitted to this Site shall be deemed and remain the property of the Site and we shall be free to use, for any purpose, anywhere and in any format, any ideas, concepts, know-how or techniques contained in the information you may provide to daCompany Tech through this Site. The Site shall not be subject to any obligations of confidentiality regarding such information, except as specifically stated in our privacy policies, specifically agreed to or required by law. You are advised that the Site does not want you to provide, and prohibits you, from providing any information or materials that are defamatory, threatening, obscene, harassing, or otherwise unlawful or offensive, or that incorporate the proprietary material of another without authority.

Our Servers

We may use third-party advertising companies to help tailor site content to users or to serve ads on our behalf.  These companies may employ cookies, web beacons, and analytics to measure advertising effectiveness.

 

When you visit the Site, our servers automatically collect the following information on our site: Your Internet protocol address ("IP address"), browser type, domain names, access times, and operating system. This information allows us to keep the Site restricted to areas with legislation, and in accordance with Apple’s app guidelines for distribution. You location can also be used to provide tailored recommendations you might be interested in, like ads.

 

We may also use third-party analytics tools to help us measure traffic and usage trends for the Service. These tools collect information sent by your device or our Service, including the web pages you visit, add-ons, and other information that assists us in improving the Service. We collect and use this analytics information with analytics information from other Users so that it cannot reasonably be used to identify any particular individual User.

Others, including third party analytics service providers, may also collect personal data about your online activities over time and across different web sites when you use our Site. This Privacy Policy does not apply to and we are not responsible for those other parties.

Cookies & Beacons 

We use cookies and navigational data like Uniform Resource Locators (URLs) to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. This type of information is collected to make our products and services more useful to you. In some of our emails to you, we will use a “click-through URL” to make your experience as easy as possible. When you click on one of these URLs, our web server detects that you clicked on the link from your email before arriving at your destination website. Tracking click-throughs helps us determine your interest in particular topics and helps us measure the effectiveness of our customer communications.

Cookies are small pieces of information that a web site sends to your computer’s hard drive while you are viewing a web site. We may use both session Cookies (which expire when you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Site. Persistent Cookies can be removed by following Internet browser help file directions. If you choose to disable Cookies, some areas of the site may not work properly.

We may use small graphic images (also known as “web beacons”, “pixel tags” or “clear GIFs”) that typically work in conjunction with cookies to identify our users and user behavior.

Log Files

Log file information is automatically reported by your browser each time you visit a web page or app. This information can also be provided when content from the webpage or app is downloaded to your browser or device or when visiting a web page from your mobile device.
 

When you use the Site, our servers automatically record certain log file information, including your web request, Internet Protocol address, browser type, referring / exit pages and URLs, number of clicks, how you interact with links on the Service, domain names, landing pages, pages viewed, and other such information. We may also collect similar information from our servers or through third party services on emails sent to our Users which then help us track which emails are opened and which links are clicked. The information allows us to improve curated content, provide accurate reporting, and improve our Site and Services.

Links to Other Websites

This Privacy Policy does not apply to the practices of companies that we do not own or control or to people that we do not employ or manage. Our Site may provide a link or otherwise provide access to Third Party Sites. We provide these links for your convenience and have no control over, do not review, and are not responsible for Third Party Sites, their content, or any goods or services available through them. Any data you provide to Third Party Sites, you provide at your own risk. We encourage you to review the privacy policies of any Third Party Sites you choose to interact with.

Device identifiers 

When you use a mobile device to access our Service, we may access, collect, monitor, store on your device, and/or remotely store one or more "device identifiers." Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device's operating system or other software, or data sent to the device by the Site.
 

A device identifier may deliver information to us or to a third party partner about how you browse and use the Site and may help us or others provide reports or personalized content and ads. Features of the Site may not function properly if use or availability of device identifiers is impaired or disabled.

Surveys

On occasion, we may send out a survey. Your personal information in the surveys will not be used to identify you. This information will help us improve our Services.

How We Use Your Information

A large part of the Site involves how you interact with your product. We do not sell your Personal Information. In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive to:

· Remember information so you will not have to re-enter it during your visit or the next time you visit the Site; complete your transactions, administer your questions, and present you with offers for products and services we think may be of interest to you. Payment information will be used only to process payment transactions.

· Diagnose or fix technology problems

· Automatically update the Blenddy application on your device

· Resolve disputes, including issues between you and any partner service acquired via our service

· Prevent, detect, and investigate potentially prohibited or illegal activities, including enforcing our Terms of Use.

· Compare information for accuracy, including verifying information with third parties

· Respond to your inquiries and requests, including telephone calls to you, as part of our phone number verification call, newsletter surveys, offers and promotional materials related to our Service.

Information We Share With Third Parties

We recognize that customer information is an important asset to our customers and will not share personally identifiable information with anyone outside the Site or the group of companies of which the Site is a part of without your consent, except as noted in this Policy. However, we may exchange information with other companies or organizations as listed:

(i) Service Providers

We may share personal information from tools like cookies, log files, and device identifiers and location data with service providers to perform specific functions on our behalf.  For example, we use the information you provide to process and fulfill your order, including to send you email to confirm your order status, shipment and newsletters.  Similarly, we may provide our payment and transaction providers with your billing information if you place an order to facilitate your payment.

We may also share your cookie data with third party advertising partners. This information would allow third party ad networks to deliver targeted advertisements that they believe will be of most interest to you.

(ii) Law Enforcement

We may also disclose your information if requested by law enforcement officials or by a subpoena, court order or if we are required to by law. We also will release personal information if it is necessary to protect our legal rights or to protect others. For example, we may share personal information if someone attempted to use this website to commit fraud.

This may also include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

(iii) Merger

We do not sell your personally identifiable information to other companies during our regular course of business, but if we were to merge with another company we might have to disclose personal information to the other company. (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name and email address, User Content and any other information collected through the Service may be among the items sold or transferred. You will continue to own your User Content. The buyer or transferee will have to honor the commitments we have made in this Privacy Policy.

(iv) Anonymized Data

We may remove parts of data that can identify you and share anonymized data with other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

 

 

How We Store Your Information

Storage and Processing

Your information collected through the Service may be stored and processed in the United States or any other country in which the Site, its Affiliates or Service Providers maintain facilities. The Site, its Affiliates, or Service Providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.
 

By registering for and using the Site, you consent to the transfer of information to the U.S. or to any other country in which the Site, its Affiliates or Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.

 

Your privacy settings may also be affected by changes the social media services you connect to the Site make to their services. We are not responsible for the functionality, privacy, or security measures of any other organization.

Security 

In order to maintain security of your information, we use Secure Sockets Layer (SSL) software, which encrypts your inputted information. Your account information is also protected by a password for your privacy and security. It is important to keep your password private and log off once you finish using a shared computer so others can’t access your account.
 

While we use standard industry precautions to safeguard your personal information, no security system can ever be guaranteed to be completely secure. As such, we cannot ensure or warrant the security of any information you transmit to us and you do so knowingly at your own risk. Once we receive your transmission, we make reasonable efforts to ensure security on our systems.  However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software.
 

If daCompany Tech learns of a security system’s breach, we may attempt to notify you electronically so that you can take appropriate protective measures. By providing personally identifiable information to us or using this Site, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues.

Your Choices About Your Information

Your Account Information and Profile/Privacy Settings

You can update your account at any time by logging in and changing your profile settings. Unsubscribe from email communications from us by clicking on the "unsubscribe link" provided in such communications. As noted above, you may not opt out of Service-related communications (e.g., account verification, purchase and billing confirmations and reminders, changes/updates to features of the Service, technical and security notices).

Data Deletion Request

As part of our dedication to data security, customer privacy, and GDPR compliance, should your account be terminated or you request for deactivation of your account and data to be deleted, we will delete all personal information, profile images, Facebook token (if applicable), usage data, and anonymize your posts. Simply send an email to support@blenddy.com with the subject line "Requesting Data Deletion" and someone from our team will get in contact with you.

How Long We Keep Your User Content

Following termination or deactivation of your account, Blenddy, its Affiliates, or its Service Providers may retain information (including your profile information) and User Content for a commercially reasonable time for backup, archival, and/or audit purposes.

Reviewing and Correcting Information

Upon request, we will provide you with your personal information or transaction information (e.g., dates on which customers made purchases, amounts and types of purchases). You can access your information by contacting us at support@blenddy.co.

Privacy Policy Changes

As we offer new content and services we may modify our Privacy Policy. If there is any material change to our information collection and use policies, we will update this privacy statement. Your continued use of Blenddy or the Site after any modification to this Privacy Policy will constitute your acceptance of such modification.
